Regulatory Changes — Effective 1 August
What's Changing on 1 August — And What You Must Do
The National Heavy Vehicle Regulator is implementing a suite of changes to the Heavy Vehicle National Law (HVNL) framework effective 1 August. These updates affect accreditation, fatigue management, mass and dimension standards, and Chain of Responsibility obligations. Below is a plain-language breakdown of each change, who it affects, and the actions required before the deadline.
NHVR Accreditation Standard Updates
The NHVR has revised accreditation standards under the National Heavy Vehicle Accreditation Scheme (NHVAS). Operators holding Mass Management, Maintenance Management, and Fatigue Management modules must ensure their systems documentation, internal audits, and records meet the updated standard. Operators who fail to update their systems documentation before 1 August risk suspension or cancellation of accreditation. Who is affected: all NHVAS-accredited operators. Action required: review your current accreditation module documentation against the updated standard and update all non-conformances before the deadline.
Chain of Responsibility (CoR) Obligation Reinforcements
Amendments effective 1 August clarify and strengthen the primary duty obligations for all parties in the transport chain — including schedulers, consignors, consignees, and loaders. Regulators will apply heightened scrutiny to documented safety management systems and evidence that each party has taken all reasonable steps to prevent breaches. Who is affected: operators, schedulers, loaders, consignors, and consignees. Action required: review and update your CoR compliance management plan, ensure all workplace instructions reflect the updated primary duty language, and conduct staff briefings before 1 August.
Fatigue Management Record-Keeping Requirements
Updated record-keeping requirements under Standard and Basic Fatigue Management (BFM/AFM) are effective from 1 August. Specifically, work and rest records must be retained for a minimum extended period, and electronic work diary (EWD) providers must meet the updated technical standard. Who is affected: all operators managing fatigue under HVNL, including solo and two-up operations. Action required: confirm your EWD provider is compliant with the updated technical standard; review record storage and retention processes; update driver briefing documents.
Mass, Dimension and Loading Condition Changes
Revised mass and dimension conditions apply to certain vehicle configurations from 1 August, including updated access conditions for Performance-Based Standards (PBS) vehicles and amendments to loading requirements for over-dimension loads. Who is affected: PBS operators, over-dimension load operators, and operators accessing roads under Notice conditions. Action required: review all current access licences, permits, and Notice conditions against the updated requirements; update loading instructions and driver documentation.
Infringement and Penalty Scale Amendments
The penalty unit value applicable to HVNL infringement notices has been updated, increasing the financial exposure for breaches across all categories — speeding, fatigue, mass, dimension, and CoR. Who is affected: all operators subject to HVNL. Action required: review your non-conformance register, close any open non-conformances before 1 August, and ensure all workplace instructions are current and signed.

Common Questions — August Changes
Your Questions on the August NHVR Changes Answered
These are the questions TCP receives most from operators preparing for the August regulatory changes. If your question isn't here, a 30-minute compliance call will get you a direct answer.
Are there any exemptions from the August changes for small operators?
Most of the August changes apply to all operators subject to the HVNL regardless of fleet size. Some accreditation obligations vary by module, for example, operators running Standard Hours (not AFM or BFM) face different record-keeping obligations than accredited fatigue management operators. TCP can assess your specific configuration and confirm exactly which obligations apply to your operation.
Is there a grace period after 1 August for operators who haven't completed updates?
The NHVR has not announced a formal grace period for the August changes. Enforcement agencies are authorised to act against non-compliance from the effective date. Operators are strongly advised to complete all required updates before 1 August. If you are behind, contact TCP immediately, a targeted engagement can prioritise the highest-risk non-conformances first.
What are the penalties for non-compliance after 1 August?
Penalty exposure depends on the category of breach. With the updated penalty unit value, infringement notices across fatigue, mass, CoR, and accreditation categories carry increased financial penalties compared to previous rates. More significantly, CoR primary duty breaches carry the risk of executive liability and prosecution, not just infringement notices. TCP strongly recommends completing a full compliance review before the deadline.
How do auditors assess compliance with the new August standards?
NHVR-accredited auditors assess conformance against the current published NHVAS audit standard and the relevant module standard. From 1 August, auditors will apply the updated standard. Common audit failure points include outdated systems documentation, incomplete record-keeping, staff who cannot demonstrate awareness of current workplace instructions, and non-conformance registers with unresolved items. TCP prepares operations for audit readiness as a core service.
Can TCP attend our NHVR audit with us?
Yes. TCP provides on-site audit support, including pre-audit preparation, documentation review, and attendance on the day to liaise with the auditor and manage any non-conformances raised. This is one of our most requested services in the lead-up to the August changes, book early as capacity is limited.
