End-to-End Transport Compliance.

From the Boardroom to the Cab

Protecting directors, operators, and drivers across every link in the chain.

Transport Compliance Partners delivers specialist compliance expertise to Australia's top-of-chain supply businesses, owner-operators, employed drivers, and transport HR teams. Whether you sit at the boardroom table or behind the wheel, we ensure your obligations are met, your risks are managed, and your business is protected.

Chain of Responsibility. Top-of-Chain Supply Protection is our specialty.

If your business sits at the top of the supply chain, as a dairy processor, milk company, FMCG manufacturer, or major retailer and you subcontract transport operators to move your product, you carry Chain of Responsibility (CoR) obligations under the Heavy Vehicle National Law (HVNL). That means your directors are personally exposed if something goes wrong in the transport chain you control.

What We Do for Top-of-Chain Businesses

  • CoR compliance audits across your subcontracted transport network
  • Review and strengthening of transport contracts and service agreements
  • Assist with appropriate information for Request for Tender
  • Development of Safety Management Systems aligned to HVNL obligations
  • Director-level briefings on personal liability and due diligence requirements
  • Incident response support — what to do when a transport event occurs in your supply chain
  • Ongoing compliance monitoring and annual review frameworks

Our consultants have worked at the executive level of Australia's transport and logistics sector. We do not offer generic compliance checklists  we build tailored frameworks that withstand regulatory scrutiny and protect your directors.

Support Services for Employed Drivers

Employed drivers are among the most important — and most overlooked — parties in the transport compliance chain. When something goes wrong, drivers are often the first to face scrutiny. Transport Compliance Partners offers direct, plain-language support to help employed drivers understand their rights, meet their obligations, and protect themselves when it matters most.

How We Support Drivers

  • Understanding your rights and responsibilities under the HVNL
  • Guidance on fatigue obligations and how to record your hours correctly
  • Plain-language explanations of NHVR notices and enforcement actions

  • Advice on workplace disputes and employer obligations toward driver safety
  • Connecting drivers with appropriate legal or union representation when required

Our support is delivered in language that makes sense on the road — no legalese, no judgement. If you have received a notice, been involved in an incident, or simply want to understand what the law requires of you, we are here to help.

HR Investigations for Transport Businesses

Workplace misconduct, fatigue policy breaches, safety incidents, and chain of responsibility failures all create significant legal and reputational exposure for transport operators and fleet managers. Transport Compliance Partners conducts impartial, defensible HR investigations that protect the business, respect the individuals involved, and produce documented outcomes that withstand scrutiny.

Investigation Services Include

  • Workplace misconduct investigations — bullying, harassment, discrimination
  • Fatigue and work/rest hours breach investigations
  • Safety incident and near-miss investigations with root cause analysis
  • Chain of Responsibility breach inquiries involving contractors or employees
  • Documentation of findings, evidence handling, and report preparation
  • Support through Fair Work processes and NHVR enforcement responses

Every investigation is conducted with procedural fairness at its core and inline with FairWork requirements.  We produce clear, structured reports with findings and recommendations that are defensible in tribunal, before the NHVR, and at board level. Transport businesses trust us because we understand both the legal framework and the operational realities of the industry.

Frequently Asked Questions

We understand that compliance decisions carry weight. Here are clear answers to the questions we are asked most.

  • Am I a top-of-chain party under the HVNL if I subcontract transport?

If your business contracts or subcontracts the transport of goods, even through an intermediary,  and you have the ability to influence how that transport is performed, you are likely a 'scheduler', 'consignor', or 'consignee' under the HVNL. That means you carry Chain of Responsibility obligations and your directors face personal liability if those obligations are not met. We can assess your specific position in the chain and clarify your exposure and put processes in place to reduce legal risk.

  • What does a CoR compliance audit involve?

A CoR audit reviews your contracts with transport providers, your internal policies and procedures, your record-keeping practices, and the instructions or commercial pressures you apply to transport operators. We assess these against HVNL obligations and identify gaps that create director-level liability. You receive a structured report with findings and prioritised recommendations.
  • What is HR investigation support, is it legal representation?

HR investigation support is not legal representation. We conduct workplace investigations as independent, impartial specialists, gathering evidence, interviewing parties, applying procedural fairness principles, and producing defensible written reports. Where legal representation is required, we work alongside your legal team or refer you to appropriate specialists.

  • How is one-on-one driver operator support delivered?

Sessions are conducted by phone, video call, or in person depending on your location and preference. There is no set package,  we work through the specific compliance questions, obligations, or situations you are facing. Owner-operators typically engage us for a combination of initial compliance review, fatigue management guidance, and as-needed access when NHVR notices or audits arise.

  • Do you cover all Australian states and territories?

Yes. The Heavy Vehicle National Law applies in all Australian states and territories except Western Australia and the Northern Territory, which have substantially aligned laws. We provide services nationally and can work remotely with clients anywhere in Australia.
